Two Midtown Developments Appealed to OLT

We are advised that Distrikt Development has appealed two development applications (official plan amendment, zoning amendment, draft plan of subdivision) in the area of Midtown to the Ontario Land Tribunal (OLT):

Appeal by 166 South Service Inc. regarding 166 South Service Road East

Appeal by Oakville Argus Cross LP regarding 217-227 Cross Avenue and 571-595 Argus Road

Additional applications may be appealed in the near future.


About the appeal process

All property owners have a statutory right to make applications for amendments to the town’s official plan and zoning by-laws and to file appeals to the OLT if the town does not approve these applications or decide within the legislated timeframe. These are applications that were deemed complete in June 2022. A staff report was not brought to Council as staff continued to work with the applicant on the applications .


Where there has been an appeal to the Ontario Land Tribunal, the decision-making authority on the applications under appeal is transferred from Council to the Tribunal.


As Members of Council, we cannot comment on the applications as they are currently the subject of ongoing litigation before the Ontario Land Tribunal.


Council will be providing the town’s lawyers with instructions on how to proceed with the appeals upon consideration of all input received and based on professional advice.
